Terms of Service

These Terms of Service (“Terms”) govern your access to and use of all games, websites, applications, services, and any related content or features (collectively, the “Services”) provided by Amax Games Ltd (together with its affiliates, “Amax Games,” “we,” “us,” or “our”). 

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not access or use the Services. 

1. Eligibility 

You must be at least 13 years old (or the minimum age required in your country to consent to data processing without parental permission) to use the Services. If you are under 18, you may only use the Services under the supervision of a parent or legal guardian who agrees to these Terms. 

2. Account Registration 

• Account Creation. Certain Services require you to create an account. You agree to provide accurate, current, and complete information and to keep it updated. 

• Account Security. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorised use. 

• Termination of Account. We may suspend or terminate your account at any time for violation of these Terms or for any other reason with or without notice. 

3. Licence Grant 

Subject to your compliance with these Terms, Amax Games grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to: 

(a) install and use the Games on devices you own or control; and 

(b) access and use the Services for your personal, non-commercial entertainment. 

4. Ownership & Intellectual Property 

• Amax Games Property. The Services, including all games, artwork, music, code, characters, and related content (“Content”), are owned by Amax Games or its licensors and protected by copyright, trade mark, and other laws. 

• No Transfer. You do not acquire any ownership rights by using the Services. 

• Feedback. Any feedback, suggestions, or ideas you submit are voluntary, and Amax Games may use them without obligation or compensation to you. 

5. Virtual Goods & In-Game Purchases 

• Virtual Currency & Items. Virtual currency, items, or benefits (“Virtual Goods”) have no real-world value and are licensed, not sold. 

• Non-Refundable. All purchases are final and non-refundable except as required by law (including your statutory cancellation rights under the Consumer Contracts Regulations 2013 where applicable) or explicitly stated in our refund policy. 

• Price Changes. We may change prices or offerings at any time. 

• Expiration. Virtual Goods may expire or be removed without notice. 

6. User Content 

• Your Content. You may submit content such as usernames, chat messages, or user-generated levels (“User Content”). You retain ownership of your User Content but grant Amax Games a worldwide, royalty-free, perpetual, irrevocable, sublicensable licence to use, modify, and display it in connection with the Services. 

• Prohibited Content. You may not submit content that is illegal, harassing, defamatory, obscene, or infringes third-party rights. 

• Moderation. We may monitor, remove, or modify User Content at our discretion. 

7. Code of Conduct 

You agree not to: 

• Cheat, hack, or use unauthorised software. 

• Exploit bugs or glitches. 

• Harass, threaten, or bully others. 

• Impersonate Amax Games staff or others. 

• Distribute spam, malware, or unauthorised ads. 

• Reverse engineer, decompile, or extract source code. 

• Sell, trade, or transfer accounts or Virtual Goods outside the Services. 

Violation may result in account suspension, termination, or legal action. 

8. Third-Party Services 

The Services may contain links to third-party websites or services. We are not responsible for their content, privacy practices, or availability. 

9. Termination 

• By You. You may stop using the Services at any time. 

• By Amax Games. We may terminate or suspend your access immediately, without notice, for any reason, including breach of these Terms. Upon termination, your licence ends, and you must delete all copies of the Games. 

10. Disclaimers 

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. Nothing in these Terms excludes liability which cannot be excluded under applicable law. 

11. Limitation of Liability 

TO THE MAXIMUM EXTENT PERMITTED BY LAW: 

• AMAX GAMES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, EVEN IF ADVISED OF THE POSSIBILITY. 

• OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM. 

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded under English law. 

12. Indemnification 

You agree to defend, indemnify, and hold harmless Amax Games, its affiliates, and personnel from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Services, violation of these Terms, or infringement of third-party rights. 

13. Dispute Resolution & Governing Law 

• Governing Law. These Terms are governed by the laws of England and Wales, excluding conflict of law principles. 

• Jurisdiction. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales. 

• Consumer Rights. If you are a consumer, you may benefit from mandatory provisions of the law in your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions. 

14. Changes to Terms 

We may update these Terms at any time. We will notify you of material changes via the Services or email. Continued use after changes constitutes acceptance. 

15. Miscellaneous 

• Entire Agreement. These Terms (and any additional terms referenced herein) constitute the entire agreement between you and Amax Games. 

• Severability. If any provision is invalid, the remainder remains in effect. 

• No Waiver. Our failure to enforce any right does not waive it. 

• Assignment. We may assign these Terms; you may not. 

• Force Majeure. We are not liable for delays due to events beyond our reasonable control.
